General Terms and Conditions – EMP VTC, car with premium driver

Article 1

Any reservation made with EMP VTC results in full acceptance of these General Terms and Conditions.

ARTICLE 2 – RESERVATIONS

All benefits must be booked in writing.

Reservations can be made on our dedicated page https://www.emp-vtc.fr/, by phone at 0624911214 or directly by email at empvtcnarbonne@gmail.com

An e-mail confirming our availability will then be sent by our services.

All reservations must include the following information: name and contact details of the customer (address, e-mail, telephone), address of the place of pick-up and address of the place of arrival for transfers, the desired duration of the services, date and time of start of the service, number of passengers and number of luggage.

A booking confirmation must be returned, by email or by mail, marked "Good for agreement", and signed by the customer.

ARTICLE 3 – BENEFIT

The benefit is valid only once.

The service shall begin at the parking place of the vehicle, on the day and time set out in the contract previously drawn up between the parties.

It ends at the day and time of return of the vehicle to its place of departure.

In the event of a client delay, the driver will wait 15 minutes at the location of the treatment. After this period, EMP VTC will consider the benefit cancelled. This will be invoiced to the customer and will not be refunded.

If it were found that the client was not present at the meeting place, the service would be permanently lost, due to the latter and would not give any entitlement to reimbursement.

If the customer does not find the driver, he must call EMP VTC immediately to avoid being charged the full amount of the benefit.

Respect for and the proper use of the material is a must. Any deterioration of the equipment and any damage caused inside the vehicle will be borne by the customer and will be invoiced.

Smoking inside the vehicle is strictly prohibited.

The use of the seat belt is mandatory at both the front and rear of the vehicle.

Animals shall not be allowed in vehicles except in a cage or bag provided for that purpose.

EMP VTC is not responsible for items forgotten in vehicles or elsewhere during the performance.

In no case may the customer require the driver to exceed the authorized speed limit or to commit any traffic violation.

More generally, the driver reserves the right to refuse any instructions and/or requests from the customer which he or she considers to be likely to compromise the safety of the occupants of the vehicle and other road users.

The driver is a professional, and his responsibility is engaged, and he is instructed to respect and enforce the laws in force.

EMP VTC reserves the right to discontinue any service on the spot, in the event that the customer is exposed to behaviour that endangers the safety of the driver, the rented vehicle or other road users. The service will then be invoiced in full to the customer.

Customers who are too alcoholic or insulting to the driver will under no circumstances be able to take their seats in vehicles. The service will then be invoiced in full to the customer.

The volume of baggage carried is proportional to the capacity of the vehicle. They remain under the responsibility of the transported persons throughout the service.

Any change in the journey by the customer or his or her principal may result in additional charges.

The service provided by the company EMP VTC as regulated by articles L.231-1 to L.231-4 and R.231-1 to R.231-9 of the Tourism Code consists of making available to the customer of a vehicle, inextricably accompanied by the services of a driver.

The following are included in the benefit:

  • the vehicle made available to the customer;
  • the provision of a driver speaking at least in French;
  • professional insurance for passengers transported for consideration, kilometres travelled, vehicle maintenance, fuel and duration of service booking
  • the transport of the customer's luggage, within the limits of the possibilities of the vehicle.
  • the cost of tolls

Not included in the Benefit:

the cost of parking and more generally of all places of parking;

the cost of entry to the sites (museums, theatres, castles, stadiums or other);

fees for entry into public places

Article 4 – PRICES

The rates set by our simulator are indicative and may be changed according to the timetables desired. To confirm this rate, it is recommended to send a booking request. EMP VTC will confirm all details of this request, including the price of the service.

Our rates are inclusive of VAT and are expressed in Euros (€).

The VAT rate applicable for transfers is 10%.

The rate of VAT applicable for making available per hour is 20%.

The transfer tariff applies to direct travel, without stop, without stop, from the place of take-over to the place of arrival previously established in the contract.

Tariffs are applicable for operations not exceeding 2 vehicles of the same category.

Beyond this, EMP VTC reserves the right to increase its rates according to the number of vehicles desired.

Prices are per vehicle regardless of the number of persons transported (up to 3 for sedans and up to 7 for minivans).

For the provision, any time started is due.

Any additional kilometer of the contract package will be charged 1.80€ TTC/km.

  • VAT
  • the vehicle made available to the customer;
  • the provision of a driver speaking at least in French;
  • professional insurance for passengers transported for consideration, kilometres travelled, vehicle maintenance, fuel and duration of service booking
  • the transport of the customer's luggage, within the limits of the possibilities of the vehicle.
  • making available on board service vehicles (fresh drinks, refreshing wipes, telephone chargers)
  • the cost of tolls.

Our rates do not include:

  • the cost of parking and more generally of all places of parking;
  • the cost of entry to the sites (museums, theatres, castles, stadiums or other);
  • fees for entry into public places;
  • the cost of meals and accommodation of the driver for a trip over several days.

ARTICLE 5 – REGULATION

Our services are payable in cash, in euros, online on board the vehicle when taking over the customer.

We accept payments in cash and by credit card (Visa, Mastercard, American Express, Paypal ...).

In all cases, the customer signing the reservation is solely responsible for payment of the service in the event of the user's default.

Any additional service, overtaking of kilometres or duration, will be charged in accordance with the price indicated on the order form.

Every race started is due in its entirety.

For wedding or excursion packages, the reservation becomes firm only after payment of a non-refundable deposit equal to 30% of the amount of the benefit.

Article 6 – Cancellation

Beyond a 15-minute waiting period at the place of care, the service will be considered due and billed to the customer.

If the client is absent, the service will be considered due and billed.

ARTICLE 7 – LIMITS OF LIABILITY

Under no circumstances can EMP VTC be held responsible for delays in rail and air traffic.

Under no circumstances can EMP VTC be held liable for delays caused by road traffic beyond its control: road barred, bridge forbidden to traffic, traffic jams, flooded road, demonstration, weather conditions, police, fire or customs operations, etc. (not exhaustive list).

Under no circumstances can EMP VTC be held liable for delays directly resulting from an initial delay by the customer, or for the need to make a journey, at the customer's request, within a clearly too short time.

In the event of immobilization of the vehicle due to mechanical failure, accident or damage (theft, degradation), EMP VTC will endeavour to ensure the continuity of the journey, either with one of these vehicles or with a vehicle chartered to another company and undertakes to notify the originator.

ARTICLE 8 – INSURANCE

The liability of EMP VTC is limited to the terms of our insurance contract.

Our vehicles are insured for the transport of people and our passengers for all personal damage to our insurer. This insurance also covers professional civil liability, in accordance with the French regulations in force, pursuant to article L. 3120-4 of the Transport Code.

The payer shall have the option of taking out additional insurance to cover cancellation costs, repatriation costs or baggage carried.

ARTICLE 9 – PERSONAL DATA

EMP VTC is committed to respecting the privacy of its customers.

EMP VTC undertakes to respect the confidentiality of the personal data collected on its website in accordance with the French Informatique et Liberté law n°78-17 of 6 January 1978. As such, EMP VTC undertakes not to disclose to third parties the information provided by the customer on its website and to use it only for the processing of its reservation. The client may exercise a right of access to his or her file and a right of correction or deletion of his or her information by sending his or her request to the EMP VTC Service.

ARTICLE 10 – LITIGES

Any complaint must be notified in writing and by registered letter to the attention of the Customer Service, within a maximum of 8 days. After this period, no claim can be resolved.

Subject to legal provisions, any dispute is, by express agreement, the exclusive jurisdiction of the Narbonne Commercial Court.
